General Sales Conditions

 

Purpose

These General Terms and Conditions of Sale (hereinafter “GTC”) define the rights and obligations of the parties regarding the sale of services by La Villa Guy & Spa.

They apply to remote bookings of services offered by our establishment, whose contact details are specified in the booking confirmation document. They govern all steps necessary for the booking and follow-up between the contracting parties. The client acknowledges having read and accepted these GTC and the specific rate conditions available on our booking platform.

These GTC apply to all bookings made online via our booking platform. Any booking implies the client’s unconditional acceptance of these GTC.

 

Bookings and Stay Conditions

The client selects services presented on our booking platform. They acknowledge understanding the nature, destination, and booking procedures for the services available, and confirm having obtained any additional information needed to make the reservation in full knowledge. The client is solely responsible for choosing services suitable for their needs, and our liability cannot be sought in this regard.

2.1 Booking and Confirmation

Bookings are made via the online booking form on our platform. A reservation is considered confirmed upon receipt of the booking form.

The client must complete all required information truthfully and accurately. After selecting services, the booking process includes entering credit card details (for guarantee or prepayment), reviewing and accepting the GTC and rate conditions, and confirming the booking.

  • A booking is only firm after written confirmation from La Villa Guy & Spa and payment of a deposit or card pre-authorization.
  • The establishment reserves the right to refuse any booking depending on availability or commercial policy.

Acknowledgment of Booking:
The platform sends an email confirmation detailing the contract offer, services booked, prices, accepted rate conditions, booking date, after-sales information, and the establishment’s address for complaints.

2.2 Access and Security Conditions

  • Opening hours: 8:00 am – 8:00 pm
  • Check-in: from 2:00 pm. Arrivals after 7:00 pm must be notified in advance and approved.
  • Check-out: by 12:00 pm. Late departures are charged an extra night.
  • Access: La Villa Guy & Spa is private; owners may refuse access or cancel reservations without compensation if client behavior is incompatible with the establishment’s values.

2.3 Payment Conditions

  • Prices are in euros, including applicable taxes at booking time.
  • A credit card guarantee is required; pre-authorizations may be kept up to 14 days post-departure for potential damages or extras.
  • The balance is due upon arrival and is non-refundable in case of early departure. No-show bookings are charged in full.

 

Damages, Theft, and Client Responsibility

3.1 Damages

The client must respect the establishment and displayed objects/artworks.

  • Any damage will be charged immediately for repair/replacement.
  • La Villa Guy & Spa may debit the client’s card for damages.
  • A security deposit may be required for extended stays or exclusive rentals.

3.2 Theft and Personal Belongings

  • The establishment is not responsible for loss, theft, or damage of personal items.
  • Safes are provided in each room; valuables are recommended to be stored there.
  • No liability for theft in vehicles parked on site, even if secured.

 

Cancellation and No-Show

  • Clients do not have a right of withdrawal (French Consumer Code, Art. L221-28).
  • Rate conditions specify cancellation/modification terms. Prepaid bookings are non-modifiable and non-refundable.
  • All bookings are personal and non-transferable.

4.1 Cancellation Terms

  • Cancellation must be in writing; phone cancellations are not accepted.
  • 15 days: free cancellation
  • 15–7 days: 50% charged
  • <7 days or no-show: 100% charged
  • Early departure: full stay remains due

Special rates with different cancellation conditions take precedence when specified.

 

House Rules

5.1 Respect for Premises and Other Guests

  • Strictly non-smoking; violation: €250 cleaning fee
  • Pets allowed only with written authorization (€30/day)
  • Excessive noise may result in immediate expulsion without refund

5.2 Use of Common Areas

  • Spa access for guests only, by reservation.
  • Secure parking provided, but the establishment is not liable for accidents, theft, or damage.
  • Electric scooter and bike rental: client responsible for safety and usage.

 

Complaints

Claims for non-performance or poor performance of services must be submitted in writing within 14 days of departure.

 

Prices

  • Prices displayed before and during booking are confirmed to the client in EUR, including VAT.
  • Prices vary by room category and season, and may change without notice.
  • Updated rates and availability are always accessible via the online booking module.
  • Tourist tax: €1.08 per person/day, extra

 

Payment

  • Client provides credit card details for booking guarantee (Visa, Mastercard, etc.).
  • Payment may be collected at booking (prepaid rates) or upon arrival (balance).
  • No-show bookings are charged per GTC and rate conditions.
  • Payment security is ensured via Payline.

 

Privacy

  • Personal data collected for booking and stay management.
  • Data may be processed by the establishment, Payline, Stripe, and partners.
  • Phone numbers kept only as long as necessary for stay management.
  • Clients have rights of access, correction, deletion, limitation, and objection (contact: contact@lavillaguy.com).

 

Proof Agreement

Entering credit card information and accepting GTC constitutes electronic signature equivalent to handwritten signature. IP address logged at booking.

 

Force Majeure

Events beyond control (natural disasters, strikes, pandemics, service interruptions, etc.) suspend obligations. Neither party liable for force majeure events.

  • Governed by French law.
  • Exclusive jurisdiction: Aix-en-Provence courts.

 

Entire Agreement

GTC, rate conditions, and booking form constitute the full agreement. Online GTC may be updated; new versions apply automatically to future bookings.

 

Applicable Law and Litigation

  • French law applies.
  • Disputes: Aix-en-Provence courts.

 

Mediation

  • Clients may use free mediation for any dispute (French Consumer Code, Art. L.612-1).
